Data protection in relation to:

Job and employment

The processing of personal data relating to employees and other staff members is an integral and necessary part of running an organisation. However, data protection requirements must be observed to ensure that the information is processed lawfully, e.g. for use in the recruitment process, the conclusion of employment contracts, salary payments, sick leave, use of employee images, dismissal, and much more.

We are ready to advise you on the many aspects of processing personal data in employment relationships, including the preparation of relevant privacy policies, consents, contracts, etc.

Technology law

Cloud, AI, ChatGPT, IoT, robots, drones are just some of the new technologies we are seeing gain ground, and all of them have data protection in common to some extent. Whether you are a public authority looking to implement a new AI-based case management tool, a private company providing a general cloud solution to your customers, or a start-up developing scanning technology for cancer treatment, you will be faced with data protection requirements.

Our specialists are ready to advise you on the interaction between the many new technologies and data protection requirements.

Transactions

More and more companies are becoming increasingly dependent on business and customer data, including personal data, in order to provide their services and build trust among their customers. Data is often also a major factor in valuation, and this is precisely where compliance with data protection requirements plays a particularly important role. The requirements may vary depending on whether the acquisition is a full or partial takeover of the company, but in all cases, the seller must always be able to document the legal basis for processing, the preparation of relevant records of processing activities, data protection policies and procedures, etc.

Our team of specialists is involved throughout the transaction process and is ready to provide professional advice on the data protection requirements that apply to your specific transaction.

The public sector

The processing of personal data is part of everyday case handling in the public sector. However, the type and volume of personal data and the increasing use of new technologies, such as AI and cloud computing, also mean that the public sector is subject to more requirements to process data lawfully and securely. This includes the requirement to appoint a data protection officer (DPO). At the same time, the public sector is subject to many other rules, including the Public Administration Act and the Freedom of Information Act, which can both support and conflict with data protection rules.

We are ready to help you with all aspects of data protection requirements.

SME

It can be a big challenge for small and medium-sized businesses to familiarise themselves with data protection requirements and comply with complex rules without hindering their daily operations.

That is why we offer to prepare the necessary GDPR documentation for you for a fixed fee. We have boiled down the mandatory documentation to four documents that make it easy for you to implement and maintain in your daily operations:

  • A comprehensive GDPR document containing procedures for compliance with data protection requirements
  • Article 30 inventory, i.e. a mapping of all processing activities
  • Privacy policy for external parties (customers, website visitors, suppliers, etc.)
  • Privacy policy for employees.

Please contact one of our specialists to learn more about this offer.

Commercial and contracts

The secure handling of customers’ and business partners’ personal data is the foundation of any good business. This requires, among other things, that all relevant contracts for the processing of personal data are in order, e.g. data processing agreements with relevant customers and/or suppliers, contracts for the transfer of data outside the EU, and any other data exchange agreements with relevant parties.

We are experts in the commercial handling of personal data, and with our solid contractual expertise, we ensure that your business complies with all data protection requirements in your contracts.

Marketing law

For many companies, digital marketing is a crucial element in reaching new potential customers. When your company targets specific content to customers via websites, platforms, apps, emails or other media based on data collection, e.g. through the use of cookies, spy pixels, Google Analytics, Facebook Business Tools or other tracking tools, both data and personal information are collected. This means, in particular, that data protection rules must be observed.

At Focus Advokater, our Tech Team is ready to help your company ensure that its marketing complies with the rules.
